Abstract

The production of food products and consumer goods by mixing halal and haram ingredients is an issue among Muslim consumers. The  istihalah and istihlak theory in determining halal food and goods is still being debated. This is because jurists have different views regarding its acceptance as a method of changing the status of goods from unclean to clean. This article aims to explain the concept of the istihalah and istihalak theory as an instrument for the determination of Islamic law. This study is qualitative. The data is collected through document analysis by referring to authoritative fiqh books, several journals and internet references that can be trusted as data sources. The data are analyzed and described using inductive, deductive and comparative methods to obtain results that coincide with the objectives of the study that have been set. The study's findings show that these two theories are the methods of purification of food and goods according to Islamic Law and are applied as instruments for determining Islamic law. However, the difference in the views of jurists on the theory of istihalah is categorized into two, namely the Hanafiyyah group that expands it and the Shafi`iyyah group that narrows the scope of its application. However, for the theory of istihlak, the difference between the two groups is not seen as significant, thus proving that there is room for unification between the two views.
